Hi I need some advice as the agency i use wants me to guarantee 12 hrs each shoft as the client wants 12 hrs each day which im happy to provide . However the agency will only guarantee me 8 hrs even though it is requiring me to do 12. My question is should the 12 hrs be guaranteed by the agency to myself if thats what they require to offer me work. Basicaly i have to agree to 12hrs or they say they wont offer me work is this legal as the ir35 statement just says hours should be agreed before the start of the shift. Surley if i get the job done quicker i should get the agreed hours but they say not. I am also worried that by this action by the agency that they will fall foul of both ir35 and anti slavery laws because i am being coerced into 12 hr shifts which i may not want to do or get no work from this agency. As i work for various clients i can move however this client is paying the best rates so every time i do less than 12hrs i lose buisiness income.
